1. This section contains information regarding the management methods of Emporium in relation to the processing of Emporium users' data.

This information notice is also valid for the purposes of Article 13 of Regulation (EU) No. 2016/679, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, for individuals interacting with Emporium and can be accessed at the address corresponding to the homepage:

3. The information is provided only for Emporium and not for other websites that may be accessed by the user through links contained therein.

4. The purpose of this document is to provide guidance on the methods, timing, and nature of the information that data controllers must provide to users when connecting to the web pages of Emporium, regardless of the purposes of the connection itself, in accordance with Italian and European legislation.

5. The information notice may be subject to changes due to the introduction of new regulations in this regard, therefore users are invited to periodically check this page.

1 - Data Controller

1. The data controller is the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. It is also responsible for security aspects.

2 - Data controller

1. The data processor is the natural or legal person, public authority, agency, or other body that processes personal data on behalf of the data controller.

2. Pursuant to Article 28 of Regulation (EU) No. 2016/679, upon appointment by the data controller, the data processor for the Emporium site is: FE.PA. ART di BACHINI B.

3 - Data processing location

1. The data processing generated by the use of Emporium takes place at Via Leopoldo Tiberi 3, 06123, Perugia.

2. In case of necessity, the data related to the newsletter service may be processed by the data controller or by subjects appointed by them for this purpose at the relevant location.


III - COOKIES

1 - Type of Cookies

1. The Emporium website uses cookies to make the user's browsing experience easier and more intuitive: cookies are small text strings used to store certain information that may concern the user, their preferences, or the Internet access device (computer, tablet, or mobile phone) and are mainly used to adjust the site's operation to the user's expectations, offering a more personalized browsing experience and storing previously made choices.

2. A cookie consists of a small set of data transferred to the user's browser by a web server and can only be read by the server that performed the transfer. It is not executable code and does not transmit viruses.

3. Cookies do not record any personal information and any identifiable data will not be stored. If desired, it is possible to prevent the saving of some or all cookies. 2 - Technical cookies

1. There are numerous technologies used to store information on the user's computer, which are then collected by websites. Among these, the most well-known and widely used are HTML cookies. They are used for navigation and to facilitate the user's access to and use of the site. They are necessary for the transmission of communications over an electronic network or for the provider to deliver the service requested by the customer.

3 - Third party cookies

1. In relation to origin, cookies are distinguished as those sent directly to the browser by the site being visited and third-party cookies sent to the computer by other sites and not by the one being visited.

2. Permanent cookies are often third-party cookies.

3. Most third-party cookies consist of tracking cookies used to identify online behavior, understand interests, and thus personalize advertising proposals for users.

4. Third-party analytical cookies may be installed. They are sent from domains of said third parties external to the site.

5. Third-party analytical cookies are used to detect information about user behavior on Emporium. The detection occurs anonymously, in order to monitor performance and improve the site's usability. Third-party profiling cookies are used to create profiles related to users, in order to propose advertising messages in line with the choices made by the users themselves.

6. The use of these cookies is governed by the rules set by the third parties themselves, therefore, users are invited to review the privacy policies and instructions for managing or disabling cookies published on the respective web pages.

4 - Profiling cookies

1. Profiling cookies are those that create user profiles and are used to send advertising messages in line with the preferences expressed by the user while browsing the internet.

2. When these types of cookies are used, the user must give explicit consent.

3. Article 22 of Regulation (EU) 2016/679 and Article 122 of the Code regarding data protection will apply.


IV - DATA PROCESSED

1 - Data processing methods

1. Like all websites, this site also uses log files in which information collected automatically during user visits is stored. The information collected may include the following:

- internet protocol (IP) address;  

- type of browser and device parameters used to connect to the site;  

- name of the internet service provider (ISP);  

- date and time of visit;  

- visitor's referral and exit webpage;  

- possibly the number of clicks.

2. The aforementioned information is processed in an automated form and collected exclusively in an aggregated form in order to verify the correct functioning of the site, and for security reasons. Such information will be processed based on the legitimate interests of the owner.

3. For security purposes (anti-spam filters, firewalls, virus detection), the automatically recorded data may also include personal data such as the IP address, which could be used, in accordance with the applicable laws, to block attempts to damage the site itself or to harm other users, or in any case harmful or criminal activities. Such data is never used for the identification or profiling of the user, but only for the protection of the site and its users, and this information will be processed based on the legitimate interests of the owner.

If the site allows the posting of comments, or in the case of specific services requested by the user, including the possibility of sending a Curriculum Vitae for a potential employment relationship, the site automatically detects and records some identifying data of the user, including the email address. Such data is considered voluntarily provided by the user at the time of the service request. By posting a comment or other information, the user expressly accepts the privacy policy and specifically consents to the content being freely disseminated to third parties. The data received will be used exclusively for the provision of the requested service and only for the time necessary for the provision of the service.

2 - Purpose of data processing

1. The data collected by the site during its operation is used for the purposes indicated above and for the following purposes:

data request for account activation, for marketing and/or advertising purposes through the sending of newsletters, for the creation of discount vouchers or gift cards

2. The data will be retained for the period strictly necessary to achieve the purpose indicated above and in any case no longer than 5 years.

3. The data used for security purposes (blocking attempts to damage the site) are retained for the time strictly necessary to achieve the aforementioned purpose.

3 -Data provided by the user

1. As indicated above, the optional, explicit, and voluntary sending of emails to the addresses listed on this site entails the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message.

V. USER RIGHTS

1. Art. 13, para. 2 of Regulation (EU) 2016/679 lists the rights of the user.

2. The Emporium website therefore intends to inform the user of the existence of the user's rights, based on the following articles of Regulation (EU) 2016/679:

a) Based on art. 15, the right of the data subject to request access to personal data from the controller, based on art. 16 the possibility to rectify the provided data, based on art. 18 the possibility to supplement or restrict the processing concerning them, or to object, for legitimate reasons, to their processing based on art. 21, in addition to the right to data portability based on art. 20 Regulation (EU);

b) the right to request deletion pursuant to Art. 17, anonymization, or blocking of data processed in violation of the law, including data that does not need to be retained in relation to the purposes for which the data was collected or subsequently processed.

c) the right to obtain confirmation that the operations of updating, rectification, integration of data, deletion, blocking of data, transformation have been brought to the attention, also regarding their content, of those to whom the data have been communicated or disseminated, except in cases where this fulfillment proves impossible or involves a manifestly disproportionate use of means compared to the protected right.

3. Requests can be addressed to the data controller without formalities or, alternatively, by using the form provided by the Data Protection Authority, or by sending an email to: info@emporiumart.com

4. If the processing is based on Art. 6, paragraph 1, letter a) – express consent for use – or on Art. 9, paragraph 2, letter a) – express consent for the use of genetic, biometric, health-related data, revealing religious or philosophical beliefs or trade union membership, revealing racial or ethnic origin, political opinions – the user has the right to withdraw consent at any time without affecting the lawfulness of the processing based on the consent given before the withdrawal.

5. Similarly, in the event of a violation of the regulations, the user has the right to file a complaint with the Garante per la Protezione dei Dati Personali, the authority responsible for overseeing data processing in the Italian State.

VI - DATA TRANSFER TO NON-EU COUNTRIES

1. This site may share some of the data collected with services located outside the European Union area. In particular with Google, Facebook, and Microsoft (LinkedIn) through social plugins and the Google Analytics service. The transfer is authorized and strictly regulated by Article 45, paragraph 1 of Regulation (EU) 2016/679, for which no further consent is required. The aforementioned companies guarantee their adherence to the Privacy Shield.

2. Data will never be transferred to third countries that do not comply with the conditions set out in Article 45 et seq. of the Regulation (EU).


VII. SECURITY OF DATA PROVIDED

1. This site processes user data in a lawful and correct manner, adopting appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of data. The processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the purposes indicated.

2. In addition to the owner, in some cases, categories of appointees involved in the organization of the site (administrative, commercial, marketing, legal staff, system administrators) or external parties (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data.
