I - INFORMATION REGARDING THE SITE'S PRIVACY POLICY

1. This section contains information regarding the management methods of Emporium concerning the processing of data of Emporium users.

2. This information notice also applies for the purposes of article 13 of Regulation (EU) no. 2016/679, concerning the protection of natural persons with regard to the processing of personal data as well as the free movement of such data, for subjects interacting with Emporium and is accessible at the address corresponding to the homepage:

3. The information notice is provided only for Emporium and not for other websites that may be accessed by the user through links contained therein.

4. The purpose of this document is to provide indications regarding the methods, timing, and nature of the information that the data controllers must provide to users at the time of connection to the web pages of Emporium, regardless of the purposes of the connection itself, according to Italian and European legislation.

5. The information notice may be subject to changes due to the introduction of new regulations on the matter; users are therefore invited to periodically check this page.

6. If the user is under 14 years old, pursuant to art.8, c.1 of Regulation (EU) 2016/679, and Art. 2 - Quinquies of Legislative Decree 196/2003, as amended by Legislative Decree 181/18, they must legitimize their consent through the authorization of the parents or their legal representatives.


II - DATA PROCESSING

1 - Data controller

1. The data controller is the natural or legal person, public authority, service, or other body that, alone or jointly with others, determines the purposes and means of processing personal data. They also handle security aspects.

2 - Data processor

1. The data processor is the natural or legal person, public authority, service, or other body that processes personal data on behalf of the data controller.

2. Pursuant to Article 28 of Regulation (EU) No. 2016/679, by appointment of the data controller, the data processor of the Emporium site is: FE.PA. ART di BACHINI B.

3 - Data processing location

1. The data processing generated by the use of Emporium takes place at Via Leopoldo Tiberi 3, 06123, Perugia.

2. If necessary, data related to the newsletter service may be processed by the data controller or subjects appointed by them for this purpose at the relevant office.


III - COOKIES

1 - Type of Cookies

1. The Emporium site uses cookies to make the user's browsing experience easier and more intuitive: cookies are small text strings used to store some information that may concern the user, their preferences, or the Internet access device (computer, tablet, or mobile phone) and are mainly used to adapt the site's operation to the user's expectations, offering a more personalized browsing experience and storing previously made choices.

2. A cookie consists of a small set of data transferred to the user's browser from a web server and can only be read by the server that performed the transfer. It is not executable code and does not transmit viruses.

3. Cookies do not record any personal information and any identifiable data will not be stored. If desired, it is possible to prevent the saving of some or all cookies. 2 - Technical cookies

1. There are numerous technologies used to store information on the user's computer, which are then collected by websites. Among these, the best known and most used is that of HTML cookies. They serve for navigation and to facilitate the user's access to and use of the site. They are necessary for the transmission of communications over an electronic network or for the provider to deliver the service requested by the customer.

2. Settings to manage or disable cookies may vary depending on the internet browser used. In any case, the user can manage or request the general disabling or deletion of cookies by modifying the settings of their internet browser. Such disabling may slow down or prevent access to some parts of the site.

3.The use of technical cookies allows safe and efficient use of the site.

Cookies inserted into the browser and retransmitted via Google Analytics or through the Blogger statistics service or similar are technical only if used for site optimization purposes directly by the site owner, who can collect aggregated information on the number of users and how they visit the site. Under these conditions, the same rules regarding information and consent apply to analytics cookies as those provided for technical cookies.

From the duration perspective, session temporary cookies that are automatically deleted at the end of the browsing session and serve to identify the user and thus avoid logging in on every visited page can be distinguished from permanent cookies that remain active on the PC until expiration or deletion by the user.

6. Session cookies may be installed to allow access and stay in the reserved area of the portal as an authenticated user.

7. They are not stored persistently but only for the duration of the browsing session until the browser is closed and disappear upon closing it. Their use is strictly limited to transmitting session identifiers consisting of random numbers generated by the server necessary to allow safe and efficient exploration of the site.

3 - Third-party cookies

1. Regarding origin, cookies sent to the browser directly from the site being visited are distinguished from third-party cookies sent to the computer from other sites and not from the one being visited.

2. Permanent cookies are often third-party cookies.

3. Most third-party cookies consist of tracking cookies used to identify online behavior, understand interests, and thus personalize advertising proposals for users.

4. Third-party analytical cookies may be installed. They are sent from domains of the aforementioned third parties external to the site.

5. Third-party analytical cookies are used to detect information about user behavior on Emporium. Detection occurs anonymously, in order to monitor performance and improve the usability of the site. Third-party profiling cookies are used to create profiles related to users, in order to propose advertising messages in line with the choices expressed by the users themselves.

6. The use of these cookies is governed by the rules set by the third parties themselves; therefore, users are invited to review the privacy policies and instructions to manage or disable cookies published on the respective web pages.

4 - Profiling cookies

1. Profiling cookies are those that create profiles related to the user and are used to send advertising messages in line with the preferences expressed by the user during web browsing.

2. When these types of cookies are used, the user must give explicit consent.

3. Article 22 of Regulation (EU) 2016/679 and Article 122 of the Data Protection Code will apply.


IV - PROCESSED DATA

1 - Data processing methods

1. Like all websites, this site also uses log files in which information collected automatically during user visits is stored. The collected information may include the following:

- internet protocol (IP) address;  

- type of browser and parameters of the device used to connect to the site;  

- name of the internet service provider (ISP);  

- date and time of visit;  

- visitor's referring and exit web page (referral);  

- possibly the number of clicks.

2. The aforementioned information is processed in an automated form and collected exclusively in aggregate form in order to verify the correct functioning of the site, and for security reasons. Such information will be processed based on the legitimate interests of the data controller.

3. For security purposes (anti-spam filters, firewall, virus detection), the data automatically recorded may also include personal data such as the IP address, which could be used, in accordance with the laws in force, to block attempts to damage the site itself or to harm other users, or in any case harmful or criminal activities. Such data are never used for the identification or profiling of the user, but only for the protection of the site and its users; such information will be processed based on the legitimate interests of the data controller.

4. If the site allows the insertion of comments, or in case of specific services requested by the user, including the possibility to send the Curriculum Vitae for a potential employment relationship, the site automatically detects and records some identifying data of the user, including the email address. Such data are considered voluntarily provided by the user at the time of the service request. By entering a comment or other information, the user expressly accepts the privacy policy, and in particular consents that the inserted contents may be freely distributed also to third parties. The received data will be used exclusively for the provision of the requested service and only for the time necessary to provide the service.

5. The information that site users choose to make public through the services and tools made available to them is provided by the user knowingly and voluntarily, exempting this site from any liability regarding possible violations of laws. It is the user's responsibility to verify that they have permission to enter personal data of third parties or content protected by national and international regulations.

2 - Purpose of data processing

1. Data collected by the site during its operation are used for the purposes indicated above and for the following purposes:

data request for account activation, for marketing and/or advertising purposes through the sending of newsletters, for the creation of discount coupons or gift cards

2. Data retention will be carried out for the period strictly necessary to achieve the purpose indicated above and in any case not exceeding 5 years.

3. Data used for security purposes (blocking attempts to damage the site) are kept for the time strictly necessary to achieve the aforementioned purpose.

3 -Data provided by the user

1. As indicated above, the optional, explicit, and voluntary sending of emails to the addresses indicated on this site involves the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message.

2. Specific summary information will gradually be reported or displayed on the site's pages prepared for particular on-demand services.

5 - Social Network Plugins

1. This site also incorporates plugins and/or buttons for social networks, in order to allow easy sharing of content on your favorite social networks. V. USER RIGHTS

1. Art. 13, para. 2 of Regulation (EU) 2016/679 lists the user's rights.

2. The Emporium website therefore intends to inform the user about the existence of the user's rights, based on the following articles of Regulation (EU) 2016/679:

a) Under art. 15, the data subject's right to request access to personal data from the controller, under art. 16 the possibility to rectify the data provided, under art. 18 the possibility to integrate or limit the processing concerning them, or to object, for legitimate reasons, to their processing under art. 21, in addition to the right to data portability under art. 20 of the Regulation (EU);

b) the right to request deletion under art. 17, the transformation into anonymous form or the blocking of data processed in violation of the law, including those for which retention is not necessary in relation to the purposes for which the data were collected or subsequently processed.

c) the right to obtain certification that the operations of updating, rectifying, integrating data, deleting, blocking data, transformation have been communicated, including regarding their content, to those to whom the data were disclosed or disseminated, except where such compliance is impossible or involves the use of means manifestly disproportionate to the protected right.

3. Requests can be addressed to the data controller, without formalities or, alternatively, using the form provided by the Data Protection Authority, or by sending an email to the address: info@emporiumart.com

4. If the processing is based on art. 6, paragraph 1, letter a) – explicit consent to use – or on art. 9, paragraph 2 letter a) – explicit consent to use genetic, biometric, health data revealing religious or philosophical beliefs or trade union membership, revealing racial or ethnic origin, political opinions – the user has the right to revoke consent at any time without affecting the lawfulness of processing based on consent given before the revocation.

5. Likewise, in case of violation of the regulations, the user has the right to lodge a complaint with the Data Protection Authority, the authority responsible for monitoring processing in the Italian State.

VI - DATA TRANSFER TO NON-EU COUNTRIES

1. This site may share some of the data collected with services located outside the European Union area. In particular with Google, Facebook, and Microsoft (LinkedIn) through social plugins and the Google Analytics service. The transfer is authorized and strictly regulated by Article 45, paragraph 1 of Regulation (EU) 2016/679, so no further consent is required. The above-mentioned companies guarantee their adherence to the Privacy Shield.

2. Data will never be transferred to third countries that do not comply with the conditions set out in Article 45 et seq. of the Regulation (EU).


VII. SECURITY OF PROVIDED DATA

1. This site processes user data lawfully and correctly, adopting appropriate security measures aimed at preventing unauthorized access, disclosure, modification, or unauthorized destruction of data. The processing is carried out by means of IT and/or telematic tools, with organizational methods and logics strictly related to the indicated purposes.

2. In addition to the data controller, in some cases, categories of persons in charge involved in the organization of the site (administrative, commercial, marketing, legal staff, system administrators) or external parties (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data.
